MOTOmed Portal: Terms and conditions
1. Scope of Application
These General Terms and Conditions (GTC) govern the use of the MOTOmed Portal, which is provided by RECK-Technik GmbH & Co. KG (hereinafter referred to as the "Operator"). The Portal offers registered users, particularly specialist retailers, importers, clinics, institutions, health insurance companies, and other MOTOmed partners, exclusive access to information, services, promotions, materials, and tools related to MOTOmed.
2. Registration and Access
(1) The use of the MOTOmed Portal requires prior registration. The user commits to providing truthful information during registration and to securely storing their access data.
(2) The operator reserves the right to reject registration requests or block existing access if misuse of the Portal is detected.
3. Copyright and Usage Restrictions
(1) All content on the MOTOmed Portal, including texts, images, videos, documentation, and software, is protected by copyright.
(2) The reproduction, distribution, modification, or transmission of content to third parties is not permitted without the explicit consent of the operator.
(3) A violation of these regulations may result in legal consequences and the blocking of the user account.
4. Disclaimer
(1) The operator does not guarantee the completeness, accuracy, or timeliness of the provided content.
(2) The use of the provided information, especially the MOTOmed service tutorials, is at the user's own risk. The operator is not liable for any damages resulting from the use or incorrect application of the content.
(3) Liability for technical disruptions, data loss, or temporary unavailability of the Portal is excluded.
5. Maintenance and Repair
(1) Maintenance and repair activities may only be carried out by or under the supervision of qualified personnel who, due to their professional training, knowledge, and experience, are capable of assessing repairs and identifying potential impacts and hazards.
(2) Only original parts and accessories may be used for assembly or modification.
(3) The standards IEC 62353:2014 | EN 62353:2014 | VDE 0751-1:2015-10 "Medical electrical devices - Recurrent tests and testing after repair of medical electrical devices" must be observed.
6. Data Protection
The processing of personal data is carried out in accordance with the applicable data protection regulations. Further information is provided in the Portal's privacy policy.
7. Contract Term and Termination
(1) The use of the MOTOmed Portal is generally unlimited in duration.
(2) The operator may terminate access to the Portal at any time with appropriate notice or discontinue the operation of the Portal.
(3) Users may delete their account at any time without providing a reason.
8. Final Provisions
(1) The operator reserves the right to change these terms and conditions at any time. Registered users will be informed of significant changes in a timely manner.
(2) The law of the Federal Republic of Germany applies.
(3) Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
